CropLife America (“CLA”) is committed to respecting the privacy and security of all visitors to our Sites. This Privacy Policy applies to the processing of personal information on https://www.croplifeamerica.org/, https://www.farmervoicesmatter.org/, https://www.pestfacts.org/ and all online properties controlled by CLA. Those Sites and online properties are referred to collectively in this Privacy Policy as the “Sites.”

 

This Privacy Policy does not apply to:

  • Any specific contracts agreed to by the parties and relationships that may be governed by further privacy agreements. If you are engaging with us on behalf of your employer, others in your company, or are otherwise providing the personal information of others, by engaging with us, you acknowledge and agree that you have the consent of the other individual to provide that individual’s personal information to CLA.
  • Links to other websites not controlled by CLA, such as to relevant online resources, our partners’ websites, and other third party websites. We are not responsible for the privacy practices or the content of these other websites.

Personal Information Collected

 

In a few areas on our Sites, online support tools, and occasionally at our events, we ask you to provide personal information that will enable us to enhance your experience and/or the event, to assist you with technical support issues, or to follow up with you after your visit. We may also receive your personal information directly from your employer when we are asked to create an account on your employer’s behalf. We may also collect information from third parties, such as your employer, service providers, and via online tracking technologies like cookies when you visit or interact with our Sites. Please see the section “Cookies and Similar Technologies” for more information about these tools.

When we use the term “personal information” we mean any information relating directly or indirectly to an identified or identifiable natural person, which may also be referred to as “personal data” under applicable law. The types of personal information we collect from you depends on how you interact with us and Sites you use. Below, we have outlined the personal information that we, or third parties working on our behalf, collect from and about you.

  • We may collect your full name, address, telephone number, social media handle, and email address.
  • Account Information. We may collect information from you when you sign up for a membership with us. That information may include, among other things, your Identifiers, account username, account password, employer name, position, and any other information you provide.
  • Professional or Employment Information. This may include your employer’s or organization’s name, address, telephone number, facsimile number, and email address; your job title; work email, work address, and work email; and your employer’s or organization’s website address.
  • Audiovisual Content. We may collect photos, videos, or similar content when you choose to share that information with us or via our social media pages.
  • Payment and Financial Information. This may include payment information, such as your payment card number, expiration date, billing address and payment account name.
  • Commercial Information. We may collect information regarding your membership or donations.
  • Demographic Information. We may collect your demographic information, such as your age, gender, ethnicity, city, state, and country.
  • Health Information. Information about your disability status if you attend one of our events.
  • Internet or Other Electronic Network Activity. We may collect information about how you and your devices interact with the Sites. This could include features you use, the web pages you visit, and the search terms you enter. This could also include information about your devices and the network you use to connect to our services, including IP addresses, device identifiers and information about the performance of the services you use on the Sites and any problems you experience with them.
  • Geolocation Information. We may collect your general location information, such as via your IP address, when you visit our Sites.
  • Content of Communications: We may collect the content of your phone calls or emails when you contact us, including your preferences in receiving communications from us.
  • Other Information You Provide to Us. We may collect additional content and information that you voluntarily provide us, such as when you post a comment or send us feedback.

Cookies and Similar Technologies

 

We use, and allow certain third parties to use cookies, social media pixels, web beacons, Software Development Kits (“SDKs”), and other similar online tracking technologies (collectively, “cookies”) to provide our Sites, services, and to help collect data. We, or third parties, may use session cookies or persistent cookies. Session cookies only last for the specific duration of your visit and are deleted when you close your browser. Persistent cookies remain on your device’s hard drive until you delete them or they expire.

 

We may also use software tools called “session replay technology” to monitor how you interact with our Sites. The personal information collected by this technology may include which links you click on, pages and content you view, information that you type into our online forms, recordings of mouse clicks and movements, and information about your device or browser.

  • Performance and Analytics. We use our own cookies and/or third-party cookies to see how you use our Sites in order to enhance their performance and develop them according to your preferences. Note that Google’s opt-out mechanism is specific to Google activities and does not affect the activities of other ad networks or analytics providers that we may use.

We may allow certain third parties (including advertisers, third party ad networks, and other ad companies) to use cookies to provide our services, serve advertisements on the Sites, and to improve the performance of CLA’s advertising across the Internet. Please be advised that such advertising companies may gather personal information about your visit to the Sites or other sites to enable such advertising companies to market products or services to you, to monitor which ads have been served to your browser, and which webpages you were viewing when such ads were delivered.

Browser “Do Not Track” Signals: Some browsers offer a “do not track” (“DNT”) option. Because no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, we do not respond to DNT signals.

How We Use Your Personal Information

 

The information you provide will be used to support your relationship with the CLA and its members, and for the following purposes:

 

  • To provide you with updates and other information from CLA.
  • To try to ensure the Sites are relevant to your needs.
  • To help us improve, create, and publish content most relevant to you.
  • To provide you with important notices.
  • To manage your account through the Sites, allow you access to limited entry areas of the Sites, verify access to accounts, and handle other visitor and account support inquiries.
  • To contact you in response to inquiries that you submit on the Sites.
  • To generate web analytics and compile user information for marketing purposes, advertising, conducting marketing analysis, providing you with recommendations for products or services based on your profile, and promotional material planning and distribution.
  • To protect out Sites, network, business operations, accountholders, and to stop activities that may violate our policies or be fraudulent or illegal.
  • To comply with applicable laws or legal process and/or respond to requests from public and government authorities, such as to comply with valid law enforcement requests or court orders.

 

In processing personal information, we may rely upon the following lawful bases:

 

  • Consent. We may process personal information with the consent of the individual whose personal information is being processed and/or in reliance upon the consent of the administrator of the account, who must affirm that they have obtained appropriate consent from all participants.
  • Contract. When we enter a contract with you and/or an administrator for your account, we process personal information on the basis of our contract in order to prepare and enter into the contract, as well as to perform and manage our contract. This is necessary for us to provide the Sites to you.
  • Vital interests. In a case where the personal information is required to protect your vital interests or the vital interests of another natural person, then this may be used as the lawful basis of the processing. For example, we may need to process personal information in the event of a pandemic.
  • As required by law. We may process personal information as required to comply with any legal obligations to which we are subject, including for the purpose of compliance with the European Economic Area, UK, or Swiss public, governmental, judicial, or other regulatory authorities. This could include where we are legally required to disclose your information to third parties.
  • For legitimate business purposes. This includes, but is not limited to, legal compliance and the purposes described above, such as the processing of your personal information to understand your usage of our Sites, improve the content of our Sites, and improve the user experience generally, taking into account a balancing of your rights and freedoms.

Disclosure of Personal Information

 

We may disclose your personal information as follows:

  • With our employees for our internal business purposes, such as to provide our Sites and services.
  • With event sponsors and service providers when you attend one of our events.
  • CLA may use email and mailing addresses voluntarily provided by Site visitors to notify them of updates, products, services, or upcoming events.
  • With third-party service providers, agents, or independent contractors who help us maintain our Sites and provide other administrative services to us (including, but not limited to, processing your requests, order processing and fulfillment, providing customer service, maintaining and analyzing data, and sending customer communications on CLA’s behalf).
  • With law enforcement, a government agency, or an investigatory body to comply with the law, a valid court order or subpoena, or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, including the rights and property of CLA and the Sites to protect someone’s personal safety.
  • With third parties as part of any corporate reorganization process.
  • With our employees or other third parties, to monitor and protect our Sites, services, and employees, as well as to stop any activities that may be fraudulent or illegal, for debugging purposes, and to protect the security of the Sites and the personal information we have collected.
  • For any other reasons that we may describe to you at the time your personal information is collected.

Disclaimer Regarding Video Content

 

The Sites may contain video content, audiovisual content, or content of a like nature (collectively, “Video Content”). In connection with our provision of Video Content, the Sites may utilize online tracking technologies and code-based tools, including, but not limited to, Software Development Kits (“SDKs”), pixels, and advertising and analytics cookies that track information about your activity and webpage-viewing history on the Sites (collectively, “cookies”). Cookies on the Sites may result in information about your activity on the Sites being transmitted from your browser to us and third parties, which, in turn, may result in the display of targeted advertisements on third-party Sites, platforms, and services, including advertisements for our content. In addition, whether cookies on the Sites result in your browser’s transmission of information to third parties depends on a number of factors that may be outside of our knowledge or control, including what third-party Sites you use, what information you have provided to such third parties, and whether (and the extent to which) you have limited the use of cookies by the operators of those third-party Sites, platforms, and services.

Social Media Pages & Other Public Posting Areas

 

Please note that any personal information you include in a message you post to any social media page, online forum, or other public posting area is available to anyone with access. If you do not want people to know your email address, for example, do not include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN ONLINE FORUMS, ON SOCIAL MEDIA PAGES, AND IN OTHER PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN THESE PUBLIC POSTING AREAS.

Security and Retention

 

No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information you transfer to CLA is done at your own risk.

 

Once we receive your transmission, we make reasonable efforts to ensure security on our systems. If we learn of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Sites or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Sites. We may post a notice on our Sites if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

Children’s Personal Information
The Sites are not intended for use by children, defined as persons under the age of 13, or minors, defined as persons under the age of 18. CLA does not knowingly collect information from children or minors, and if we learn that a person under the age of 18 has provided CLA with personal information, we will delete such personal information.
International Transfer of Personal Information

If you choose to provide us with personal information, we may transfer that personal information to our affiliates and subsidiaries or to other third parties, in accordance with local law. We may also transfer your personal information across borders, from your country or jurisdiction to other countries or jurisdictions in accordance with legal requirements. If you are visiting from Canada, the European Economic Area (“EEA”) or other regions with laws governing personal information collection and use that may differ from United States law, please note that you are transferring your personal information to the United States which does not have the same data protection laws as the EEA and may provide more limited recourse mechanisms, including dissimilar or, at times, weaker data protection rights. With knowledge of these risks, by providing your personal information you understand that: (i) your personal information will be processed as outlined above and in accordance with this Privacy Policy; and (ii) there may be a transfer of your personal information to the United States as indicated above.

Choices & Rights that May Apply to You

  • Email Opt-out: We communicate with our members and other individuals via email. Generally, users cannot opt-out of these communications, as they will be primarily informational in nature rather than promotional. However, if we send you an email that promotes a commercial product or service, you may click on the “unsubscribe” link provided within that communication. We will process your unsubscribe request as soon as possible and in accordance with applicable law, but please be aware that in some circumstances you may receive additional messages prior to the unsubscribe request being processed. You also may opt-out of receiving such promotional emails by clicking on the “unsubscribe” link within the text of the email.
  • Text or SMS Messaging: We may also offer text/SMS messaging to you. In some circumstances, we might require you to opt-in to receive text messages from us. At any time, you may opt-out of receiving particular text messages from us by texting STOP in response to any text message.
  • California’s “Shine the Light” Law: California law permits visitors to our Sites who are California residents to request certain information regarding CLA’s disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us at the address provided below. Please indicate in your request that you are a California resident making a “Shine the Light” inquiry.
  • Nevada’s Privacy Law: Residents of Nevada have the right to opt-out of the sale of certain pieces of their personal information to third parties. Currently, we do not engage in such sales.

Your Canadian Privacy Rights

  • You may have the right to access and obtain a copy of your personal information in a structured, commonly used technological format, or have us send a copy of your personal information to another person or body.
  • You may have the right to correct, rectify, or complete your personal information if inaccurate or incomplete.
  • Where consent is relied upon to process your personal information, you have the right to withdraw consent, subject to legal restrictions.
  • Users who are located in Canada have the right to lodge a complaint about our privacy practices with a supervisory authority.

Individuals located in the European Economic Area, the UK, and Switzerland

 

Provided that you are located in the European Economic Area, the United Kingdom, Switzerland, or in a country in which the GDPR otherwise applies, you may have the following data subject rights in accordance with the EU GDPR (EU Regulation no. 2016/679) or UK GDPR (UK Data Protection Act 2018) (together, along with any revision or substation thereof, “GDPR”).

 

  • The right to access your personal information and to confirm whether your personal information is being processed.
  • The right to receive a copy of your personal information in a structured, commonly used and machine-readable format or where technically feasible to have it directly transferred to another controller. For more copies, we may charge a reasonable fee. If you make the request by electronic means, and unless otherwise requested, the data shall be provided in electronic form.
  • You may have the right to correct, rectify, or complete your personal information if inaccurate or incomplete.
  • You may have the right to the deletion or erasure of your personal information (the “right to be forgotten”).
  • You may have the right to request that we restrict our processing of personal information.
  • The right to object to processing of your personal information which is based on our legitimate purposes.
  • Where consent is relied upon to process your personal information, you have the right to withdraw consent, subject to legal restrictions.

Submitting a Request. Subject to certain exemptions, and in some cases dependent upon the processing we are undertaking, you have certain rights in relation to your personal information. We may ask you for additional information to confirm your identity and for security purposes, before disclosing the personal information requested to you. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly or inform you if we require further information in order to fulfil your request.

 

In accordance with Art. 21 GDPR, you have the right to object to the processing of your data, provided that the reason for the objection arises from your particular situation and it concerns data that we process to protect one of our interests worthy of protection or if it concerns the use of your data for direct marketing.

 

If you have given us consent to process your personal information, you can withdraw this consent at any time without providing reasons and with effect for the future at the email address provided above.

Changes to This Privacy Policy

We reserve the right to change this Privacy Policy from time to time. When we do, we will also revise the “Effective Date” date at the top of this Privacy Policy. If we are going to use information in a manner that is materially different from that stated at the time of collection or make any material changes to our privacy practices, we will notify you either by email or by posting a prominent notice on our Sites, as required by applicable law.
